the agreement

By joining the Otto waitlist, signing up for an Otto trial, or paying for Otto, you agree to these Terms. If you don't agree, don't use Otto. These Terms form a binding contract between you and Rhys James Trevethan trading as Otto (ABN: 37 750 733 139) ("Otto", "we", "us").

what otto is

Otto is an SMS-based AI chief of staff. Otto reads your calendar and other productivity signals with your explicit OAuth consent, and sends proactive text messages to help you stay on top of your work. Otto is software, not a human. He has opinions but no duty of care.

eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction, if higher).
  • You must have a valid phone number capable of receiving SMS.
  • You must have a Google or Microsoft calendar account to connect.
  • Only one trial per phone number. VoIP numbers may be rejected.

waitlist

Joining the waitlist doesn't guarantee access. We invite waitlist members in batches, paced by regulatory and infrastructure constraints. Waitlist membership does not constitute payment or subscription. We may remove waitlist entries for suspected fraud or abuse without notice.

trial and billing

  • 7-day free trial — no credit card required to start.
  • At the end of the trial, you will be asked to subscribe to continue using Otto.
  • Subscription fees are charged monthly. Current pricing is displayed at otto-hq.com and may change with 30 days' notice. Payments are processed by Stripe.
  • Billing is monthly unless you select annual (2 months free).
  • You may cancel at any time from otto-hq.com/settings, or by stopping payment when the next bill is due. Cancellation takes effect at the end of the current billing period.
  • We don't offer refunds for partial months, but we're reasonable — write to hello@otto-hq.com if something feels wrong.

sms consent

By providing your phone number and agreeing to these Terms, you expressly consent to receive automated SMS messages from Otto, including daily briefings, meeting prep summaries, nudges, and service messages. Standard carrier message and data rates may apply. Message frequency varies based on your calendar and configured settings — typically 3–7 messages per workday. Consent to receive SMS is not a condition of purchase.

  • Reply STOP at any time to pause all messages. No further automated messages will be sent. Your account and data are retained for 30 days, then permanently deleted. Reply RESUME within that window to reactivate.
  • Reply DELETE to begin permanent account deletion. Otto will send a confirmation — reply CONFIRM DELETE within 24 hours to complete. This cannot be undone.
  • Reply PAUSE (optionally with a duration, e.g. PAUSE 2 days) to silence Otto temporarily.
  • Reply HELP for support contact information.
  • Carriers are not liable for delayed or undelivered messages.

acceptable use

You agree not to:

  • Abuse Otto with automated messages, prompt injection, or attempts to extract other users' data.
  • Use Otto to process illegal content or for any unlawful purpose.
  • Reverse engineer, scrape, or resell Otto's outputs as a commercial service.
  • Create multiple trial accounts to bypass the paywall.

Otto may suspend or terminate accounts that abuse the service. We'll usually warn you first. We won't if the abuse is severe.

otto's limitations

Otto is an AI. He infers, interprets, and sometimes misfires. You are the final decision-maker on your own calendar, your own priorities, and your own work. Otto's suggestions are not professional advice — legal, medical, financial, or otherwise. Never rely on Otto as the sole source of truth for anything that matters.

Otto's calendar write permissions are limited: he can create focus blocks and deadline reminders, and delete his own events. He cannot move, cancel, or modify events he didn't create.

your content and data

You retain ownership of all content Otto reads from your calendar and connected accounts. You grant Otto a limited licence to process that data solely to provide the service. Otto's data handling is described in the Privacy Policy, which is part of these Terms.

third-party services

Otto depends on Google, Microsoft, Anthropic, Stripe, Supabase, Twilio, Trigger.dev, and Vercel. Their terms apply to their portions of the service. We're not responsible for outages, policy changes, or account suspensions on those platforms.

warranty disclaimer

Otto is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of fitness for a particular purpose, merchantability, or uninterrupted availability. We don't guarantee Otto will always be accurate, timely, uninterrupted, or error-free. Nothing in this clause limits any rights you may have under the Australian Consumer Law, including consumer guarantees that cannot be excluded by law.

limitation of liability

To the maximum extent permitted by law, Otto's total liability to you for any claim arising from these Terms or your use of Otto is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, consequential, or punitive damages — including missed deadlines, lost opportunities, or damaged relationships.

indemnification

You agree to indemnify, defend, and hold harmless Otto and its operator from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your use of the service in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) any third-party claim resulting from content you submit or actions you take through the service.

force majeure

We are not liable for any failure or delay in providing the service caused by circumstances beyond our reasonable control, including outages or failures of Twilio, Anthropic, Google, Microsoft, Stripe, Supabase, or Vercel; telecommunications network failures; acts of God; natural disasters; or government actions.

severability

If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Otto regarding your use of the service.

termination

You can terminate at any time: text STOP or DELETE, cancel in settings, or stop paying. We can terminate your account for breach of these Terms, for suspected fraud, or for abusive behaviour. On termination, we delete your data per the Privacy Policy. Sections 08, 09, 11, 12, 13, 15, 16, and 17 survive termination.

changes to terms

If we materially change these Terms, we'll notify you by SMS at least 14 days before the change takes effect. Continued use after that constitutes acceptance.

governing law

These Terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria, unless your local consumer-protection laws require otherwise.
